Terms of Service

Effective date: August 14, 2026

These Terms of Service (“Terms”) govern your use of Zephyrwrite software and related services operated at zephyrwrite.com and app.zephyrwrite.com (together, the “Service”). By downloading the desktop app, creating an account, purchasing a license, or subscribing to Zephyrwrite Cloud, you agree to these Terms.

1. Who we are

Zephyrwrite is a desktop writing application (built with Tauri) and an optional cloud backup service. The operator of zephyrwrite.com and app.zephyrwrite.com (“we,” “us,” or “Operator”) provides the Service. Marketing content lives on zephyrwrite.com; accounts, licensing, and billing are handled at app.zephyrwrite.com.

2. The products

2.1 Desktop license (one-time purchase)

Zephyrwrite Desktop is licensed for a one-time purchase. A valid license lets you install and use the app on devices you own or control, for your own writing work. The license is personal to you (or your organization, if purchased that way). You may not resell, rent, sublicense, or publicly redistribute the licensed software except as allowed by applicable open-source components bundled with it.

2.2 Zephyrwrite Cloud (subscription)

Zephyrwrite Cloud is an optional paid subscription that provides encrypted backups of your projects. Cloud features are gated by an active subscription. If a subscription ends or is cancelled, backup upload and restore through Cloud may stop; local copies of your manuscripts on your devices remain yours.

3. Accounts

Accounts use magic-link sign-in (email link authentication). You are responsible for keeping access to your email secure. Do not share account access in a way that lets others misuse your license or Cloud subscription. We may suspend accounts that show abuse, fraud, or clear violations of these Terms.

4. Payments

Payments for licenses and subscriptions are processed by Stripe. We do not store full payment card numbers on our servers. Prices, taxes, and billing intervals are shown at checkout on app.zephyrwrite.com. By completing a purchase you authorize Stripe to charge the payment method you provide.

5. Your manuscripts and content

You own the manuscripts and other content you create with Zephyrwrite. These Terms do not transfer ownership of your writing to us. You grant us only the limited rights needed to operate Cloud backups when you choose to use them (for example, storing and transmitting encrypted backup data on your behalf).

6. Encryption and Cloud backups (important)

Zephyrwrite Cloud uses server-side envelope encryption (sometimes described as “Level 2” encryption). This is not zero-knowledge encryption. The Operator holds encryption keys necessary to provide the backup service. That means:

  • Your backup data is encrypted at rest on our systems using keys we manage.
  • We (and anyone who obtained our keys or compelled access to systems that use them) could, in principle, decrypt Cloud-stored content.
  • If confidentiality against the Operator is a requirement for your work, do not rely on Zephyrwrite Cloud; keep manuscripts only on devices you control.

Local files on your computer are under your control. Cloud is optional and exists for convenience and recovery—not as a guarantee that we cannot read encrypted backups.

7. Acceptable use

You agree not to:

  • Attempt to break, overload, or reverse-engineer the Service beyond lawful rights;
  • Use the Service to distribute malware or to violate others’ rights;
  • Circumvent license or subscription checks;
  • Misrepresent yourself when contacting support or processing payments.

8. Intellectual property

Zephyrwrite branding, the desktop application (aside from third-party and open-source components with their own licenses), and the Service design are owned by the Operator or its licensors. Your purchase grants a license to use the software—not ownership of our IP.

9. Disclaimer of warranties

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Writing software and backups can fail; keep your own local copies of important work.

10. Limitation of liability

To the fullest extent permitted by law, the Operator is not liable for indirect, incidental, special, consequential, or lost-profits damages, or for loss of data arising from use of (or inability to use) the Service. Our total liability for claims relating to the Service is limited to the amounts you paid us for the product or subscription giving rise to the claim in the twelve (12) months before the claim.

11. Changes

We may update these Terms. Material changes will be posted on this page with an updated effective date. Continued use after changes take effect constitutes acceptance of the revised Terms.

12. Governing law
